Terms and Conditions for the Provision of Passenger Transport Services aboard the „Odra Queen”

The Terms enter into force on 1 April 2024 and apply to all Agreements concluded with the Carrier.


§1. Definitions

  • Terms — the General Terms and Conditions for the Use of Transport Services aboard the „Odra Queen”.
  • Agreement — the agreement for the provision of Services, incorporating the Terms, concluded between the Carrier and the Passenger, acting directly or through authorised agents, representatives or intermediaries.
  • Ticket — the document confirming that an Agreement has been concluded between the Carrier and the Passenger.
  • Carrier — KJT SP. Z O.O., Wichrowe Wzgórza 76/4, 72-001 Siadło Dolne, Poland, NIP (Tax ID): 8513270890, REGON: 521305236.
  • Passenger — a person using the Service under an Agreement.
  • Disabled Person or Person with Reduced Mobility — a Passenger who is a disabled person or a person with reduced mobility within the meaning of Regulation (EU) No 1177/2010.
  • Baggage — items under the control of, or in the possession of, the Passenger.
  • Necessary Medical Equipment — medical and assistive equipment required by a Disabled Person or Person with Reduced Mobility.
  • Assistance Dog — a specially trained, marked and vaccinated dog required by a Disabled Person or Person with Reduced Mobility, holding a valid training certificate and current vaccinations.
  • Valuables — valuable items or documents, such as means of payment, jewellery, etc.
  • Carriage — the service of transporting persons and their Baggage under an Agreement.
  • Service — the service of transporting persons and their Baggage, provided by the Carrier aboard the Ship under an Agreement.
  • Fare — the price for the Carriage or Service.
  • Sailing Schedule — the schedule of start and end times of Services on the routes operated by the Carrier.
  • Price List — the list of Fares and other charges related to the Services at individual ports on the routes operated by the Carrier.
  • Ship — the vessel „Odra Queen” used by the Carrier to provide the Services.
  • Force Majeure — external events beyond the control of the Carrier, such as wars, blockades, strikes, etc.

§2. General Provisions

  • The Terms form an integral part of all Agreements concluded by the Carrier during their period of validity.
  • The Agreement and the Terms are governed by the law of the Republic of Poland and by international regulations, in particular Regulation (EU) No 1177/2010.
  • Summaries of Regulation (EC) No 392/2009 and Regulation (EU) No 1177/2010 are attached to the Terms as annexes.
  • Any disputes will be settled by the common court having jurisdiction over Szczecin, unless otherwise provided.

§3. Agreement and Carriage

  • The Carrier undertakes to perform the Service in accordance with the Agreement and the Terms.
  • The person making a Ticket reservation must inform the Carrier of the needs of a Disabled Person or Person with Reduced Mobility.
  • Passengers are required to comply with the instructions of the crew and the regulations of the Ship.
  • The Carrier reserves the right to refuse carriage of a Passenger or their Baggage in the event of a breach of the Terms or of safety regulations.

§4. Reservations and Fares

  • Reservations may be made online, by telephone, or in person at the office of the Carrier.
  • Fares for the Carriage must be paid within the deadline specified by the Carrier.
  • Passengers wishing to receive a VAT invoice for a ticket purchased on site should report this before making the payment.
  • The fare for a ticket purchased on board may be paid in cash or by payment card.
  • The fare for a ticket purchased online may be paid by payment card, bank transfer, or via the PayU fast payment system.
  • A ticket purchased online is sent automatically, once paid, to the e-mail address provided at the time of purchase, no later than one hour after the payment is confirmed.
  • Upon boarding, the Passenger is required to present the ticket purchased online either electronically (on the screen of a mobile device) or printed on paper.

§5. Refunds and Complaints

  • Refunds are possible in accordance with the applicable provisions of Article 27 of the Act of 30 May 2014 on Consumer Rights.
  • Complaints should be submitted electronically to: info@odraqueen.pl.

§6. Baggage

  • Passengers are entitled to carry a limited amount of Baggage free of charge.
  • Hand baggage must be placed in the designated areas aboard the Ship.
  • The Carrier is not liable for valuable Baggage that was not declared before check-in aboard the Ship.

§7. Liability and Limitations

  • The liability of the Carrier for damage caused to Passengers is limited to the amount specified in applicable regulations.
  • The Carrier is not liable for damage caused by Force Majeure or by the actions of third parties.

§8. Rights of Passengers with Disabilities

  • The Carrier undertakes to ensure equal access for Disabled Persons or Persons with Reduced Mobility.
  • Passengers are entitled to request assistance with carriage and to use Necessary Medical Equipment.

§9. Changes to the Sailing Schedule

  • The Carrier reserves the right to introduce changes to the Sailing Schedule for reasons beyond its control.
  • If a sailing is cancelled, Passengers are entitled to a refund or to use another available service.

§10. Final Provisions

  • The Terms may be amended in accordance with applicable law.
  • Matters not regulated by these Terms are governed by the law of Poland.
  • These Terms enter into force on 1 April 2024 and remain in effect until amended.

These Terms and Conditions are legally binding on all Passengers using the passenger transport services aboard the „Odra Queen”.
